Right of withdrawal

Annotated.nl is a B2B subscription aimed at business customers (legal entities). The right of withdrawal under Directive 2011/83/EU does not apply to business customers as a matter of law; this policy is therefore informative in principle.

To the extent a customer would nonetheless qualify as a consumer within the meaning of Directive 2011/83/EU, the exclusion under article 16(m) described below applies.

1. When the right of withdrawal applies — and when it does not

The standard 14-day right of withdrawal (article 9 of Directive 2011/83/EU; article 6:230o of the Dutch Civil Code) applies to distance consumer contracts for services and digital content.

The right of withdrawal is excluded for the supply of digital content not delivered on a tangible medium, where performance has begun with the consumer’s express prior consent and the consumer has acknowledged that he or she thereby loses the right of withdrawal (article 16(m) of Directive 2011/83/EU; article 6:230p sub e of the Dutch Civil Code).

2. How we apply this exclusion

During checkout you are asked to confirm — in a separate checkbox — that:

“I understand that the standard 14-day right of withdrawal under Directive 2011/83/EU lapses once I am given access to the subscription (article 16(m)).”

As soon as you tick this box, your payment is completed, and your access to the annotated editions is activated (within minutes of payment), the subscription can no longer be withdrawn free of charge.

3. If you want to cancel anyway

Outside the right of withdrawal, the General Terms (AV v1.2) apply. In summary:

  • the subscription runs for a term of 12 months;
  • you may give notice no later than one month before the end of the term, otherwise the subscription is automatically renewed;
  • mid-term termination is possible under the terms, but the full term remains billable;
  • the exact terms, refund handling and notice regime are set out in the AV.

4. How to submit a cancellation or question

Send your request to office@annotated.nl. Please include in your email:

  • the name of the organisation the subscription is registered to;
  • the billing email address;
  • whether you request cancellation at end of term, or invoke a specific article of the AV.

We confirm your request within one business day and process it within 14 days.

5. Applicable law

This exclusion and the related acknowledgement are governed by Dutch law, without prejudice to mandatory consumer-protection provisions of the law of the consumer’s habitual residence.
